Are you requesting your own Lasting or Enduring Power of Attorney?
As the person who made the Power of Attorney this can be retrieved at any time. A Lasting or Enduring Power of Attorney is a private document, and we have a responsibility to ensure it is released to you solely as the person who made the document. We will require confirmation of identification before we are able to release any documents to you.
Are you acting on behalf of the owner of the Lasting or Enduring Powers of Attorney?
If we store an individual’s Lasting or Enduring Powers of Attorney we are only authorised to release to the individual or those appointed (Attorneys), who will be identified in the documents.
If the owner of the document has sufficient mental capacity to deal with their affairs and have requested that you retrieve their original Lasting or Enduring Power of Attorney document or a certified copy, we require written confirmation of the instructions authorising us to release the document to you.
If the owner of the Lasting or Enduring Power of Attorney no longer has sufficient mental capacity to deal with their own affairs, we will require written confirmation from a medical professional or from a care home provider confirming the owner of the document’s loss of capacity.
