Mark is a Partner in the Dispute Resolution team.
He is a specialist litigator handling all manner of complex and high value claims. His experience spans both commercial and property disputes, working for several high-profile and publicly listed clients.
As a commercial litigator, Mark’s experience includes acting on professional negligence claims and a diverse range of contractual disputes. His property litigation experience includes expertise in the energy and utilities sector, advising statutory undertakers on issues including injunctive relief and compulsory powers.
Mark understands the disruption that litigation can bring to a client and has used mediation, as well as other forms of dispute resolution, effectively to settle disputes.
Examples of Mark’s work supporting clients includes:
- Successfully opposing a mandatory injunction application in the High Court. The client was awarded full costs with the resulting claim being struck out following a successful security for costs application which the claimant did not meet;
- Negotiating a settlement on a high value franchise dispute in which a former franchisee was claiming damages of circa £5m for repudiatory breach of contract against a national franchisor following its wrongful termination of the franchise agreement;
- Acting for a FTSE 250 company in a £20m High Court dispute regarding a landlord’s failure to provide adequate mechanical services in a central London building;
- Making a successful application for rectification in the First Tier and Upper Tribunals. The application concerned critical apparatus forming part of the client’s distribution network. The client was successful at trial and subsequent applications for permission to appeal were successfully opposed. The client avoided significant removal costs running into the 10s of millions and achieved substantial cost recovery;
- Successfully advising an electricity distribution client on a complex necessary wayleave application to retain underground electric lines;
- Advising an electricity distribution client following receipt of contractual notices from a national railway operator to divert apparatus and enable upgrade works to the rail network. Potential liability exceeded £10m; and
- Advising on applications for injunctive relief following acts of trespass and/or nuisance.
